Producer Rights Denmark (former CAB, Filmkopi and Filmret)

Producer Rights Denmark (PRD) is the Danish collective organisation administering rights on behalf of Danish and foreign tv- and film producers and other holders of producer rights. PRD is administered by Filmret ApS. We make sure that tv- and film producers receive payment for retransmission when their productions are shown on Danish television, including digital services such as Start from the beginning, Catch Up and other smaller business areas.

The work of registration, documentation and distribution is carried out by Registration Denmark (REDK) based on the applicable principles for each area of collection. REDK is a subsidiary of Filmret ApS.

The main distributions take place in June and December, while two smaller supplementary distributions are made in September and March.

Distribution principles and criteria
The PRD board (former boards of CAB, Filmkopi and Filmret) determine the principles regarding the channels liable to payment as well as the criteria on which payments are generally based. These principles are also known as distribution keys. Both the principles of the distribution keys and the related board decisions have to be approved by the general assembly of PRD.

  • Retransmission commercial (former CAB)
    The chief selection criterion for the payment channels handled is the individual channels’ market coverage. Cable/retransmission distributions are based on the registered tv data for the Danish channels DR, DR2, DRK and TV2 Danmark.
  • Blank Media (former Blank Tape Levy, Filmkopi)
    Payments regarding blank media are primarily distributed to tv- and film producers individually. A smaller portion is distributed collectively according to Danish Law through the Collective funds.
  • Digital services (former Start from the beginning, Filmkopi)
    Payments regarding Start from the beginning, Catch Up and other digital services are based on data from actual use provided by the cable operators.
  • Tv programmes for educational purposes - TVU (former AVU, Filmret)
    Payments regarding the use of tv-content in educational institutions are distributed based on the information about productions used and lent out during the payment period in question. The information derives from the CFU (Educational Resource Centre).

  • Note
    Productions produced by tv stations themselves (eg, news programmes) and sports programmes do not receive payment through PRD. External productions inserted in between two or more in-house productions receive payment.

Claim your rights
Both Danish and foreign rights holders must claim their rights to their tv- and film productions. Claims must be made for every distribution area and prior to all main payments, so that the basis for the distributions is kept up to date.

Provided that we have the correct e-mail and contact information, REDK will send an e-mail with a claim list asking to claim the relevant rights prior to a distribution. Rights are claimed by returning the e-mail with confirmations for the relevant distribution area.

When claim e-mails are sent, a list of works associated with a conflict between rights holders are usually also attached.

Rights conflict
A rights conflict arises when two or more rights holders claim rights revenues for a tv or film production and the total claim for the given production exceeds 100%. Payment regarding a production that is the subject of a rights conflict is withheld until the conflict has been resolved. 

As a party involved in a conflict, you should contact the opposing party to clarify the distribution of the rights. REDK must then be notified of the rights distribution so that the correct payment can be made. 

Neither REDK nor Filmret ApS can make decisions in conflicts between producers or between producers and other rights holders. We are willing to assist with handling such conflicts, and you are welcome to contact REDK:

Unclaimed rights
The rights revenues become time-barred after the end of the third year. The board of PRD makes the decisions regarding the use of time-barred revenues. Both the principles of the use of time-barred revenues and the related board decisions have to be approved by the general assembly of PRD.
